Last updated: October 11, 2026

This is a translation provided for information purposes. The contract language is German; in case of discrepancies, the German version prevails.

1. Scope
1.1. The following General Terms and Conditions exclusively apply to the business relationship between Nordmark Gestaltung, Owner: Christoph Ott, Bgm.-Bodmeier-Str. 27, 83539 Pfaffing, Germany (hereinafter "Seller") and the customer (hereinafter "Customer"), in the version valid at the time of the order.
1.2. You can reach our customer service for questions, complaints and objections by e-mail at order@projekt-nordmark.de or by telephone at +49 171 950 9915.
1.3. A consumer within the meaning of these terms is any natural person who enters into a legal transaction for purposes that cannot be attributed predominantly to their commercial or independent professional activity (Section 13 German Civil Code, BGB).
1.4. Conflicting terms of the Customer are not recognized unless the Seller expressly agrees to their validity.

2. Offer and conclusion of contract
2.1. The presentation of products in the online shop is not a binding offer but an invitation to place an order. All offers apply while stocks last.
2.2. The Customer places products in the cart using the "Add to cart" button and enters the order process using the "Check Out" button. There the Customer enters their details, selects the shipping and payment method and reviews their entries using the "Review order" button. Before completing the order, the Customer can change and review their entries at any time, return to the cart using the "back" function of their browser, or cancel the ordering process. By clicking the button "Order with obligation to pay", the Customer submits a binding offer to purchase the goods in the cart.
2.3. The purchase contract is concluded as soon as the Seller accepts the Customer’s order by the order confirmation e-mail sent automatically. With this e-mail, the Customer receives the order data and the contract information (see clause 8.2).
2.4. For payment by bank transfer, the Seller provides the bank details and requests payment. If payment is not received within 10 calendar days after the order confirmation was sent, the Seller may withdraw from the contract. The goods are reserved for this period.

3. Prices and shipping costs
3.1. All prices are final prices in euros. Under Section 19 UStG (German small business regulation), no value added tax is charged and therefore none is shown.
3.2. Shipping costs are charged in addition to the prices. They are calculated based on the delivery country and the type and quantity of the items and are shown as a total amount during checkout before the order is completed. Further information can be found on the "Shipping" page.

4. Delivery, availability of goods
4.1. Information on delivery times, shipping methods and delivery countries can be found on the "Shipping" page.
4.2. If delivery fails through the Customer's fault despite several delivery attempts, the Seller may withdraw from the contract. Payments already made will be refunded without delay.
4.3. If the Seller is not supplied with an ordered product by its supplier through no fault of its own, the Seller may withdraw from the contract. The Seller will inform the Customer without delay, propose a comparable product where appropriate and refund payments already made without delay.

5. Payment
5.1. Before completing the order, the Customer selects from the payment methods displayed during checkout.
5.2. Payments are processed via Shopify Payments and PayPal. For payments with Klarna, Klarna's payment terms also apply; for PayPal, PayPal's terms apply.
5.3. Payment is due in advance without deduction, unless a provider such as Klarna offers a later payment date.
5.4. If the due date for payment is determined by the calendar, the Customer is in default simply by missing the date and must pay statutory default interest. The assertion of further damages caused by default remains unaffected.

6. Warranty and guarantee
6.1. The warranty is governed by statutory provisions. Information can be found under "Legal guarantee".
6.2. A guarantee exists only if it has been expressly given. The Customer is informed of the guarantee conditions before starting the ordering process.

7. Liability
7.1. The following exclusions and limitations of liability apply to the Seller's liability for damages, without prejudice to the other statutory requirements.
7.2. The Seller is liable without limitation where the damage is caused by intent or gross negligence.
7.3. The Seller is also liable for slightly negligent breaches of essential obligations, the breach of which endangers the achievement of the purpose of the contract, or of obligations the fulfilment of which makes proper performance of the contract possible in the first place and on the observance of which the Customer regularly relies. In this case, however, the Seller is liable only for foreseeable damage typical for this type of contract. The Seller is not liable for slightly negligent breaches of other obligations than those mentioned above.
7.4. The above limitations of liability do not apply in the event of injury to life, body or health, to defects after assumption of a guarantee for the quality of the product, or to fraudulently concealed defects. Liability under the German Product Liability Act remains unaffected.
7.5. To the extent that the Seller's liability is excluded or limited, this also applies to the personal liability of employees, representatives and vicarious agents.

8. Storage of the contract text
8.1. The Customer can print the contract text before placing the order using the print function of their browser.
8.2. The Seller also sends the Customer an order confirmation with all order data to the e-mail address provided. With the order confirmation, and at the latest upon delivery of the goods, the Customer also receives the terms and conditions, the withdrawal information with model withdrawal form and the information on shipping and payment. Registered customers can view their orders in their customer account. In addition, we store the contract text but do not make it accessible on the internet.

9. Final provisions
9.1. German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this applies only to the extent that mandatory provisions of the state in which the consumer has their habitual residence do not conflict.
9.2. The place of jurisdiction and performance is the Seller's registered place of business if the Customer is a merchant, a legal entity under public law or a special fund under public law.
9.3. The contract language is German. Translations (e.g. into English) are for information purposes only. In case of discrepancies, the German text prevails.
9.4. We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
